What this notice covers and the legal framework we work within.

This notice informs you of our policy regarding all information we hold and record about you. It sets out the conditions under which we may process any personal information that you provide to us. It covers information that could identify you ("personal information") and information that could not identify you. In the context of the law "process" means to collect, store, transfer, use or otherwise act on information.

We take the protection of your privacy and confidentiality seriously. We understand that all visitors to our website are entitled to trust that their personal information will not be used for any purpose unintended by them, and will not accidentally be transferred to a third party.

We undertake to preserve the confidentiality of all information you provide to us, and trust that you reciprocate.

It is very important that the information we hold about you is accurate and up to date. Please let us know if at any time your personal information changes by emailing us.

Our policy complies with UK law including the requirements of the General Data Protection Regulations and the Privacy and Electronic Communications Regulations (PECR).

Camera Privacy

How our public web cameras operate and the safeguards in place.

Legal Position

Public web cameras for tourism and advertising purposes that broadcast live on the internet can legally operate, without any license, if they are located in a public place and are not used for any indecent activity.

2.1

Your Privacy

Most of our live streams are scenic and coastal views that rarely have people in shot however where members of the public may get close to our cameras, we have signage in place to make members of the public aware.

The exact locations of all our cameras are provided on this website.

Although not encouraged, our cameras have become the reason to visit a specific location and many tourists like to try hard to get into the shot so they can promote this on their social channels.

We have a strict policy about posting any images on our social channels that might be able to identify someone. These are deleted and the person warned and referred to our forum guidelines.

Privacy has been considered for every location and we deploy several techniques to minimise the identification of individuals. Resolution is downgraded in our town centre public locations and views are deliberately kept wide angle making people look small and distant. We also make sure that our PTZ (pan-tilt-zoom) cameras only pause for short periods in any one area.

Sound is an important element of our destination marketing platform however our cameras do not have the capability to capture sound. Instead, we use specialised sound capture equipment to provide high quality binaural ambient sound and we merge this onto the live stream. Often the location is some distance from the camera as we only use sound where appropriate and where privacy concerns have been fully considered.

If an emergency occurred that could be captured by our cameras, we would endeavour to cut the live feed as soon as we are made aware. In addition, we have implemented automated systems with trusted third parties where the live streams are taken down as part of their own emergency procedures. These are tested on a regular basis and the live stream is only reinstated once confirmation has been received that the incident has ended.

2.2

How We Use Video and Still Images Captured

Our live streams are used solely for destination marketing and promotion for the Shetland Islands by streaming live video feeds onto this website for general public viewing.

Our cameras or our live streams are not in any way connected, used or affiliated with the police or any local authority and are not used for any surveillance, crime prevention and detection, traffic management or public safety purposes. Some of our live streams have the ability to rewind up to 12H or 24H to allow people in different time zones to see the islands in daylight. Data is overwritten after this period.

We may, however, from time to time, record and store video recordings of events that are of public interest such as, for example, aurora, seabirds nesting, sunsets, extreme weather, special events, exceptionally high tides and so on.

Such video recordings may also be published on our social media pages. We may also use still images taken from our web cameras to publish on our social media pages.

No one may record, store or use any footage captured by our web cameras, for any reason, without prior permission.

All live video streams are distributed by our own dedicated and privately owned ZETCAST content delivery network (CDN) to avoid this being shared with any other third party.

We do not link to any other webcam streams, and therefore own the video and audio workflow from glass to glass i.e., from the camera to the viewer.

2.3

Your Rights

You have the following rights:

  • To be told that a public web camera is being used using clearly visible and legible signage at each camera location.
  • You can request a copy of any footage where your image is identifiable.
  • You can request us to erase any footage that we have of you.
  • You can request that we do not capture any footage of you in future.
  • We must respond to your request within one month.

These are related to CCTV systems however as our network is not designed for surveillance, we are unlikely to be able to locate any image after a period of 24 hours has expired.

How we process information about you

The law requires that we process personal information under one of six defined bases and to notify you of the basis for each category. If a basis on which we process your personal information is no longer relevant then we shall immediately stop processing your data.

Additionally, we may aggregate this information in a general way and use it to provide information to monitor our performance with respect to a particular service we provide. If we use it for this purpose, you as an individual are not personally identifiable.
